Terms and Conditions

These Terms and Conditions are an agreement between you and lugnote.com ("LugNote", "we", "us"). They govern your use of the LugNote website, web application and related services (the "Service").
By creating an account or using the Service you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
LugNote is a record-keeping tool for vehicle maintenance. It lets you store vehicle details, service and repair history, fuel and energy records, tire history, documents, reminders and related information, and share them with people you choose.
LugNote is a tool for keeping records. It does not inspect, repair, certify or value vehicles, and it is not a substitute for a qualified mechanic, your vehicle manufacturer, an accountant or any other professional.
2. Eligibility
You must be at least 16 years old to use the Service. If you are under 18, or under the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian who agrees to these terms on your behalf. A paid subscription must be purchased by someone who is legally able to enter into a contract.
The Service is offered to people located in the United States. It is not offered to people located in the European Economic Area, the United Kingdom or Switzerland, and you may not use it from those places.
3. Your account
You must give accurate information when you register and keep it up to date. Each person may hold one account, and an account may not be shared between people.
You are responsible for everything done through your account and for keeping your password, two-factor codes and recovery codes secret. We recommend turning on two-factor authentication. Tell us immediately at the support address below if you believe your account has been accessed without your permission.
4. Households and collaborators
Records in LugNote belong to a household. The household owner controls the household, its subscription, its data and who its members are.
If you invite other people to a household, they can see and change its records according to the role you give them. You are responsible for who you invite and for what they do there. If you join a household someone else owns, the owner controls the records you add to it, including whether they are kept, exported or deleted.
5. Plans, billing and renewal
LugNote offers a free plan and paid plans. The features, limits and prices of each plan are shown on the pricing page. Plans described as unlimited are subject to fair use: use that is consistent with a household or a genuine fleet, not bulk storage or resale.
- Payment is handled by Stripe. We never receive or store your full card number.
- Paid plans are billed in advance, monthly or annually, and renew automatically at the then-current price until you cancel.
- You can cancel at any time from the billing settings. Cancellation takes effect at the end of the period you have paid for, and you keep your paid features until then.
- If you upgrade partway through a period, the charge is pro-rated.
- If a free trial is offered, its length is shown at checkout. Unless you cancel before it ends, the paid subscription begins when the trial ends.
- Prices are exclusive of taxes unless stated otherwise, and you are responsible for any taxes that apply.
- We may change prices. We will give you at least 30 days of notice by email, and a change applies from your next renewal after that notice.
If a payment fails, your subscription enters a grace period of 7 days during which your paid features keep working and payment is retried. If payment has not succeeded by the end of the grace period, the subscription is cancelled and the household moves to the free plan.
6. Refunds
Payments are non-refundable, and we do not give refunds or credits for partly used periods or for features you did not use.
We may make an exception at our sole discretion in exceptional circumstances, for example a duplicate charge, a billing error on our side, or a serious hardship. To ask for one, write to support@lugnote.com. Nothing in this section limits a refund that the law requires.
7. Downgrades and plan limits
We never delete your data because you downgraded, cancelled a subscription or missed a payment. If a household ends up over the limits of its plan, the resources over the limit become read-only: you can still view and export them, but you cannot change them or add more until you are back within the limit or you upgrade.
8. Your content
You own the records, photos, documents and other content you put into LugNote. You give us permission to host, store, copy, process, transmit and display that content only as needed to operate, secure and improve the Service for you and the people you share it with. That permission ends when the content is deleted from the Service, apart from copies that remain in backups for a limited time.
You are responsible for your content. You confirm that you have the right to upload it, including any personal information about other people that it contains, such as a co-owner, a driver or a repair shop.
You can export your data at any time, as CSV files per record type or as a full household export. We recommend keeping your own copies of documents that matter to you, such as titles, insurance and registration papers.
10. Information only, not professional advice
Everything the Service tells you is information to help you keep records. It is not mechanical, safety, legal, tax, insurance or financial advice. In particular:
- Reminders and maintenance schedules are based on generic templates and on the data you enter. They may not match what your vehicle's manufacturer requires, and a reminder may be late, wrong or not delivered at all.
- Recall information comes from the US National Highway Traffic Safety Administration and is matched by make, model and year. It may be incomplete, out of date or not specific to your vehicle. Always confirm recalls with the manufacturer or a dealer.
- Tire wear, age, rotation and seasonal alerts are estimates from the readings you enter. They do not replace a physical inspection.
- Details decoded from a VIN and values read from scanned documents by automated text recognition or AI models can be wrong. Check them before you rely on them.
- Cost, efficiency, depreciation, valuation and total cost of ownership figures are estimates. Mileage and tax-year reports are summaries of what you entered, and you are responsible for confirming that they meet the requirements of any tax authority, employer or insurer.
You remain solely responsible for the safety, maintenance, roadworthiness, registration and insurance of your vehicles.
11. Acceptable use
You agree not to:
- use the Service for anything unlawful, or upload content that is unlawful, infringing or that you have no right to share;
- upload malware or anything designed to harm the Service or its users;
- access, or try to access, another household's data, or probe, scan or test the Service for vulnerabilities without our written permission;
- get around plan limits, quotas, rate limits or other technical restrictions;
- scrape the Service or use it by automated means, except through API keys and webhooks on a plan that includes them;
- resell, sublicense or provide the Service to third parties, except as a Fleet plan allows;
- use the Service in a way that places an unreasonable load on it or interferes with other users.
12. Third-party services
The Service relies on third parties, including Stripe for payments, the US National Highway Traffic Safety Administration for VIN and recall data, and an exchange-rate provider for currency conversion. We are not responsible for the availability or accuracy of third-party services, and your use of Stripe is also governed by Stripe's own terms.
13. Our intellectual property
We own the Service, including its software, design, text and the LugNote name and logo. We give you a limited, personal, non-transferable, revocable right to use the Service under these terms. If you send us feedback or suggestions, we may use them without any obligation to you.
14. Availability and changes
We work to keep the Service available, but we do not promise that it will be uninterrupted, timely, secure or error-free, and we do not offer an uptime commitment. Support, including priority support on the Fleet plan, is provided on a reasonable-efforts basis.
We may add, change or remove features. If we remove a feature you pay for in a way that materially reduces the Service, or if we decide to shut the Service down, we will give you reasonable notice and the chance to export your data.
15. Suspension and termination
You can stop using the Service at any time. You can delete a household you own from its settings, and you can delete your account from your security settings. If you are the last member of a household, deleting your account deletes that household too. If you own a household that other people still belong to, you must remove them before you can delete your account. A deleted account or household can be restored for 30 days, after which it is permanently deleted.
We may suspend or terminate your access if you seriously or repeatedly break these terms, if your use puts the Service or other users at risk, or if the law requires it. Where it is reasonable to do so we will tell you first and give you a chance to fix the problem. Unless we terminated your access for unlawful or abusive conduct, you will have 30 days after termination to export your data.
Sections that by their nature should survive the end of this agreement do survive it, including those on your content, disclaimers, limitation of liability, indemnity and governing law.
16. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY INFORMATION IT PROVIDES, INCLUDING REMINDERS, RECALL DATA, ALERTS, SCANNED VALUES AND REPORTS, IS ACCURATE, COMPLETE, RELIABLE OR DELIVERED ON TIME.
17. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL. THIS INCLUDES ANY VEHICLE DAMAGE, BREAKDOWN, ACCIDENT, INJURY, FINE, DENIED WARRANTY OR INSURANCE CLAIM, OR OTHER LOSS ARISING FROM MISSED OR INCORRECT MAINTENANCE, REMINDERS, RECALL INFORMATION, ALERTS OR REPORTS.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND US $50.
Some jurisdictions do not allow certain disclaimers or limits, so parts of this section and the one before it may not apply to you. In that case they apply to the greatest extent the law permits.
18. Indemnity
You agree to defend and indemnify us against any claim, loss or expense, including reasonable legal fees, that arises from your content, from your breach of these terms, or from your misuse of the Service.
19. Governing law and disputes
These terms are governed by the laws of the United States and of the state in which the operator of lugnote.com is located, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located there, and you and we consent to their jurisdiction. Before filing a claim, each of us agrees to try to resolve the dispute informally for at least 30 days by contacting the other in writing.
20. Changes to these terms
We may update these terms. If a change is material we will tell you by email or in the app at least 30 days before it takes effect. If you keep using the Service after a change takes effect, you accept the updated terms. If you do not agree, you can export your data and close your account before then.
21. General
These terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver of it. You may not transfer this agreement to anyone else. We may transfer it as part of a merger, acquisition, reorganization or sale of the Service, including to a legal entity formed to operate LugNote, and we will tell you if we do.
